LADURRIE – Terms and Conditions of Use (International Version)

LADURRIE operates as an international boutique specializing in luxury lingerie and intimate apparel for women. Headquartered and manufactured in Brazil, the brand is present in the United States and France. These Terms and Conditions govern the relationship between LADURRIE and its customers, both domestically and internationally.


1. Acceptance of Terms

By accessing and using the LADURRIE website, the customer acknowledges having read, understood, and fully accepted the Terms and Conditions stated herein, regardless of their geographic location. Use of the site implies agreement with the rules established below.


2. Headquarters and Governing Law

LADURRIE is headquartered in Brazil and operates under Brazilian law, including:

  • Consumer Protection Code (Law No. 8.078/1990)

  • Brazilian Civil Code (Law No. 10.406/2002)

  • General Data Protection Law – LGPD (Law No. 13.709/2018)

International customer relationships also respect local consumer protection laws, where applicable, without overriding Brazilian law—except where mandatory legal provisions apply (e.g., right of withdrawal).


3. United States – U.S. Terms of Use

U.S. legislation allows stores to refuse returns of opened intimate clothing items due to hygiene and safety reasons. Several states legally support such exceptions, including:

  • California Civil Code §1723

  • Florida Statute §501.142

  • New York General Business Law §218-a

Additionally, the UETA – Uniform Electronic Transactions Act confirms the legal validity of digital agreement.

The U.S. customer:

  • Agrees to the no-return policy for opened or handled intimate items;

  • May request a return only in the case of a verified defect, within 7 calendar days of receipt;

  • Must provide video + photo evidence for claims;

  • Refunds will be processed via the original credit card, depending on the payment provider’s policies.


4. France – Conditions Générales d’Utilisation

LADURRIE adheres to France’s Code de la Consommation, particularly Article L221-28, Paragraph 5, which excludes the right of withdrawal for hygiene-related intimate items once unsealed.

The French customer:

  • May not return panties, nightgowns, or other intimate apparel once opened;

  • May request a return within 14 calendar days only if the product remains sealed, unused, and shows a manufacturing defect;

  • Must submit video and photo evidence for product evaluation;

  • Refunds will be issued via bank card according to the issuer’s terms.


5. Website Use

Customers from any country must use the LADURRIE website ethically and lawfully, and agree to:

  • Not cause damage to the platform;

  • Not use offensive or threatening language;

  • Not commit fraud or misuse information;

  • Provide truthful and accurate information at the time of purchase.


6. Shipping and Logistics Responsibility

All orders are shipped from Brazil using third-party logistics providers.

International customers are responsible for tracking their order via email or the carrier’s app.
Issues related to delays, errors, or lost packages must be reported directly to the carrier.


7. Right of Withdrawal – International

  • United States: 7 calendar days for defective items only (with video + photo evidence). Opened intimate items are not eligible for return, as supported by state hygiene laws.

  • France: 14 calendar days, only for sealed, unused items with proven manufacturing defects. Items in direct contact with the skin are not eligible for return per Code de la Consommation, Article L221-28, Paragraph 5.

  • Brazil: According to Consumer Protection Code – Art. 49, §1º, the right of withdrawal does not apply to intimate apparel or personal-use items in direct contact with the mucosa.


8. Digital Agreement Validity

Acceptance of these Terms of Use is electronically recorded and legally valid under:

  • Brazil: Articles 107, 421, and 422 of the Civil Code

  • U.S.: Uniform Electronic Transactions Act (UETA)

  • France: French Civil Code – Articles 1101 et seq.


9. Jurisdiction

The legal jurisdiction elected for resolving any disputes arising from the contractual relationship with LADURRIE is the District Court of Balneário Piçarras/SC – Brazil.
